These Terms & Conditions ("Terms") govern your access to and use of the Assistmate platform. Please read them carefully. By creating an account, booking a service, or otherwise using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. Definitions

  • "Platform" means the Assistmate website and related online services.
  • "Customer" or "you" means a person who books or uses services through the Platform.
  • "Helper" or "Service Provider" means an independent individual who provides assistance services and is assigned to bookings through the Platform.
  • "Services" means the personal assistance services made available through the Platform, such as bag carrying, shopping assistance, personal assistance and companionship.

2. Nature of Our Service

Assistmate operates as a technology platform and intermediary that connects Customers with independent Helpers. Assistmate is not a provider of the underlying assistance services and does not employ the Helpers. Helpers are independent service providers. We facilitate the booking, assignment and payment process; the actual service is performed by the assigned Helper.

3. Eligibility

You must be at least 18 years of age and capable of entering into a legally binding contract under the Indian Contract Act, 1872 to use the Platform. By using the Platform, you represent that you meet these requirements and that the information you provide is accurate and complete.

4. Accounts and Registration

  • You must create an account to book services. You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activity that occurs under your account. Notify us immediately of any unauthorised use.
  • You agree to provide accurate, current and complete information and to keep it updated.
  • We may suspend or terminate accounts that violate these Terms, provide false information, or are used for fraudulent or unlawful purposes.

5. Bookings

  • A booking is created when you select a service and submit the required details (service type, location, date, time and notes).
  • A booking is Pending until a Helper is assigned by our team, at which point it becomes Assigned. The service then proceeds to In Progress and, on completion, Completed.
  • Assignment of a Helper is subject to availability. We do not guarantee that a Helper will be available for every requested slot or location.
  • You agree to provide a safe environment and accurate information to enable the Helper to perform the service.

6. Pricing, Payments and Taxes

  • Prices for Services are displayed on the Platform before you confirm a booking. Final charges may vary based on the actual service performed, duration or scope, where applicable.
  • Payments are processed through third-party payment gateways. By making a payment, you authorise us and our payment partners to charge the applicable amount to your chosen payment method.
  • The prices shown for Services are the final amounts payable and are inclusive of all applicable taxes. Any statutory taxes, levies or government charges that may apply to a booking will be charged in accordance with applicable law and reflected on your receipt.
  • Invoices and receipts are made available through the Platform or by email.

7. Cancellations and Refunds

Cancellations and refunds are governed by our Refund & Cancellation Policy, which forms part of these Terms. Please review it for cancellation windows, applicable fees and refund timelines.

8. Your Responsibilities

  • Use the Platform and Services only for lawful purposes.
  • Treat Helpers with respect and provide accurate booking information and a safe working environment.
  • Do not request Helpers to perform any unlawful, unsafe, hazardous or inappropriate task.
  • Do not solicit or arrange services with a Helper outside the Platform to circumvent fees.
  • Do not misuse, disrupt, reverse-engineer or attempt to gain unauthorised access to the Platform.

9. Helper (Service Provider) Responsibilities

  • Helpers are independent providers who must complete our verification and onboarding process before being assigned to bookings.
  • Helpers agree to perform assigned services honestly, safely, professionally and in accordance with the booking details.
  • Helpers must comply with all applicable laws and must not engage in any unlawful, fraudulent or harmful conduct.
  • Helpers are responsible for their own tax obligations arising from the services they provide.

10. Conduct and Safety

We are committed to a safe and trustworthy Platform. Any abusive, threatening, discriminatory or unlawful behaviour by a Customer or Helper may result in suspension or termination. Report any safety concern to our support team immediately using the details in our Contact Us page.

11. Intellectual Property

The Platform, including its content, design, logos, trademarks and software, is owned by or licensed to Assistmate and is protected by applicable intellectual property laws. You may not copy, modify, distribute or create derivative works without our prior written consent.

12. Disclaimers

The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, regarding the Platform and the Services, including warranties of merchantability, fitness for a particular purpose and non-infringement. As an intermediary, we do not warrant the quality, timing or outcome of services performed by independent Helpers, though we work to maintain high standards through verification and oversight.

13. Limitation of Liability

To the maximum extent permitted by law, Assistmate and its directors, employees and partners shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising out of or in connection with your use of the Platform or the Services. Our total aggregate liability for any claim arising out of a booking shall not exceed the amount paid by you for that specific booking. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

14. Indemnity

You agree to indemnify and hold harmless Assistmate from any claims, damages, liabilities, costs or expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Platform, or your violation of any law or the rights of any third party.

15. Suspension and Termination

We may suspend or terminate your access to the Platform at any time, with or without notice, if you breach these Terms or if we reasonably believe your conduct may harm the Platform, other users or third parties. You may stop using the Platform and request account deletion at any time, subject to the completion of pending bookings and obligations.

16. Dispute Resolution

We encourage you to contact our support team first to resolve any dispute amicably. Any dispute that cannot be resolved informally shall be subject to the exclusive jurisdiction of the competent courts at Pune, Maharashtra, India, and these Terms shall be governed by and construed in accordance with the laws of India.

17. Changes to These Terms

We may revise these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
